1. Why this Privacy Policy?
Anyone (hereinafter referred to as the "Client") visiting and/or using our CreativeWith platform (hereinafter referred to as the "Platform") or using our services, discloses a certain amount of personal data. Personal data is information that allows us to identify you directly or indirectly as a physical person.
We collect and process your personal data in accordance with the Belgian Law of July 30, 2018 on the protection of privacy with regard to the processing of personal data ("Privacy Law") and the European Regulation of April 27, 2016 on the protection of physical persons with regard to the processing of personal data and the free movement of such data ("Regulation" or "GDPR").
By using the Platform or our services, the User declares that they have read this Privacy Policy and expressly accepts the collection and processing of your personal data in the manner described in this document.
We reserve the right to make changes to our Privacy Policy at any time.
2. Who processes your personal data?
We collect different types of info to help us run and improve our site and services for you.
2.1. The data controller
CreativeWith is the data controller and determines which personal data is collected, as well as the purposes and means of processing.
2.2. Subcontractor(s)
CreativeWith is free to use subcontractors. A subcontractor is any individual or legal entity processing your personal data at the request and on behalf of the data controller. Subcontractors are required to ensure the security and confidentiality of your data, and they always act on the data controller’s instructions.
In particular, CreativeWith uses the following categories of subcontractors:
technical and hosting providers for the Platform (for example, Teachable for hosting and delivering courses)
secure payment providers (for example, Stripe and PayPal)
marketing agencies and tools (newsletter management, promotional campaigns, email and social media communication)
IT and technical support providers
data hosting and cloud service companies
3. What is the legal basis for processing my data?
In accordance with Belgian law and the GDPR, we process your personal data based on the following legal grounds:
executing the contract you are party to or taking pre-contractual steps at your request—specifically to let you create an account, access online courses, participate in workshops or conferences, manage payments, and use our services;
complying with our legal obligations, particularly regarding contract management, billing, and accounting;
our legitimate interest, such as ensuring Platform security and maintenance, improving our content and services, communicating with our users, managing our online community, and promoting specific creator-related posts;
your explicit consent, when required, especially for sending marketing emails and promotional offers, or for using analytical cookies (see our cookie policy on our Platform).
4. What personal data do we collect?
The processing of your personal data is strictly limited to what is necessary to achieve CreativeWith's goals. The categories of data involved include:
personal identification data (first and last name, account username)
contact data (email address, phone number)
billing and payment data (bank details, transaction details via Stripe or PayPal)
platform usage data (login history, courses taken, progress, workshop or conference attendance, private community interactions)
preferences and communications data (newsletter subscriptions, marketing choices, approval or sharing of promotional content)
technical and electronic data (IP address, browser type, approximate location, cookies, and other trackers)
We also use cookies and similar technologies to recognize you, offer a personalized experience, remember your technical choices (like language, account login, cart tracking, or registration), measure traffic, and improve the Platform's performance. 5. What will it be used for?
CreativeWith collects your personal data solely to give you a great, secure, and personalized experience. Processing your data is essential for the platform, the online course platform, and the community to work properly, and to deliver our services. If any info is missing, incorrect, or incomplete, CreativeWith reserves the right to suspend or cancel certain operations.
Your data is processed exclusively for the following purposes:
managing relations with users and creators, including account admin, access to online courses, workshop or conference registrations, billing, and tracking payments
providing technical support and following up on requests or complaints
sending service-related updates, like newsletters or platform news
managing collaborations with creators, including approving and promoting content on social media
handling potential disputes and meeting our legal obligations
protecting against fraud, abuse, and violations
constantly improving the platform by analyzing usage data and statistics
marketing and personalized updates, subject to your consent, which you can withdraw at any time
When you visit the Platform, some technical data is automatically collected for stats, like your IP address, general location, access date and time, or the pages you view. This data helps us optimize how the platform works and feels.
6. Who gets your personal data?
Your personal data is mainly processed by CreativeWith's internal teams to manage the Platform, the online course platform, the community, and events. It is never sold.
However, it may be shared with certain external service providers who work on our behalf, and only as needed to perform their tasks. This includes, for example, technical and hosting providers, the Teachable platform for hosting courses, payment processors like Stripe and PayPal, or marketing providers for sending newsletters and promotional updates. In any case, these third parties are contractually bound to respect the confidentiality and security of your data.
7. How long is your data kept?
We only keep your personal data for as long as needed to fulfill the purposes outlined in this Privacy Policy. After that, it is deleted or anonymized. However, we are legally required to keep some data longer, especially for tax and accounting purposes (for example, storing invoices for 10 years). Marketing data, like newsletters and direct marketing, is kept until you withdraw your consent.
8. What are your rights?
8.1. Guarantee of fair and lawful processing
Your personal data is always handled according to the legitimate purposes outlined in section 5. We only collect and use what is necessary and relevant, and we won't keep it longer than needed to get the job done.
8.2. Right of access
If you can verify your identity, you have the right to get details about how your data is processed. This includes knowing the purpose of the processing, the types of data involved, who it's shared with, how long we keep it, and your rights regarding your data.
8.3. Right to rectification
Inaccurate or incomplete personal data can be corrected—either directly by you, or by sending us a written request.
8.4. Right to erasure (or 'right to be forgotten')
You have the right to have your personal data erased in the following cases:
Your personal data is no longer needed for its original purpose;
You withdraw your consent and there is no other legal basis for the processing;
You have validly exercised your right to object;
Your data was processed unlawfully;
Your data must be deleted to comply with a legal obligation.
8.5. Right to restrict processing
In some cases, you can ask us to limit how we use your personal data. This applies if you're disputing the accuracy of the data, if it's needed for a legal claim, or while CreativeWith is checking if you can officially request its deletion.
8.6. Right to object
You can object at any time to your personal data being processed for direct marketing, profiling, or for the legitimate interests of the data controller. CreativeWith will stop processing your data unless we can prove compelling, legitimate reasons that override your right to object.
8.7. Right to data portability
You have the right to get all the personal data you've provided to us in a structured, commonly used, and machine-readable format. At your request, we can transfer this data to another provider, unless it's technically impossible.
8.8. Right to withdraw your consent
You can withdraw your consent to process your personal data at any time, for example, for direct marketing.
9. How to exercise your rights
To exercise your rights, please send us a written request and proof of identity by registered mail or email. We'll get back to you as soon as possible, and within one (1) month of receiving your request at the latest.
10. Data Security
CreativeWith takes your personal data security seriously, using the right technical and organizational steps to protect it from unauthorized access, changes, exposure, or destruction. This includes tools like firewalls, encryption, physical and digital access controls, and information security management. That said, no data transmission or storage method is 100% secure. While we do everything we can to protect your personal data, we can't guarantee absolute security.
11. Right to lodge a complaint
If you're not happy with how CreativeWith handles your personal data, you have the right to file a complaint with the Data Protection Authority (https://www.autoriteprotectiondonnees.be/).
